The Individuals with Disabilities Education Act (IDEA) and Hawai‘i Administrative Rules (HAR), Chapter 60, protects the rights of children with disabilities, ages 3 through 21 and their parents. These protections are identified in the Procedural Safeguards Notice.
Procedural Safeguards Notice
In accordance with 34 CFR §300.504(a) and HAR §8-60-59, schools are required to provide a copy of the Procedural Safeguards Notice to you only once per school year.
A copy must also be given to you during the following circumstances:
- Upon initial referral or your request for evaluation.
- Upon receipt of the first state complaint and upon receipt of the first due process complaint in a school year.
- In accordance with discipline procedures in 34 CFR §300.530(h).
- Upon your request.
